The
San Diego BBB is alerting consumers about tragedies such as the
October - November 2007 devastating wildfires throughout Southern
California, which often bring out a flurry of con artists who can take advantage of property owners who have suffered property losses.
Crocked Home Improvement Contractors.
This
scam takes advantage of property owners who have suffered fire‑related
losses as well as losses from unforeseen future rain damage resulting
from fire damage. Consumers should be aware of home‑improvement
scams, and other fraudulent schemes that might surface in the wake of
the devastating wildfires.
The
BBB warns that teams of fly‑by‑night, itinerant repairmen
and "unlicensed contractors" will often breeze into devastated
neighborhoods in unmarked vehicles, even before the smoke is cleared,
and promise to rebuild, or repair a roof or minor structural damage on
a home, or haul away damaged property - on an all‑cash basis (cash
under the table). After up‑front cash is paid, supposedly to buy repair
supplies, the scamsters can walk away without completing the work, leaving the property with a mess. The scam artist may attempt to convince homeowners that their
insurance coverage will cover all costs, when in fact it may not. After
they scam as many people as possible, they leave town, never to be seen
or heard from again. Property
owners who can't get up on the roof to see if the chimney, skylight, or
roof covering really are damaged, bogus repair workers, and unlicensed
contractors may allege substantial repairs are needed. In
addition, crooked home improvement contractors may swarm to devastated
neighborhoods demanding high down payments with no intention of doing
the work.The
BBB recommends selecting a reputable, ethical state licensed
contractor who carries liability insurance and workers comp for their
employees.
Be
wary of contractors soliciting business door-to-door. Ask to see the
salesperson’s driver’s license and write down and verify the license
number www.cslb.ca.gov and
the person’s license plate. Check for a permanent place of business,
telephone number, tax identification number, and business license. Although
you may be anxious to get things back to normal, avoid acting in haste.
Do not succumb to high‑pressure tactics, such as “the price is only
good for today.” Con artists are not concerned with cooling‑off laws.
Never
sign a blank contract, and always ask for a receipt for any payment.
Checks should be made out to the business, not the individual selling
the service. Be suspicious if you are asked to pay for the entire job
in advance. State law limits a down payment of no more than 10 percent
of the repair cost or $1,000, whichever is less. Also, never make a
final payment until the work has been completed as agreed upon.
Unlicensed usually means uninsured. If you use a contractor who is uninsured, it could mean the contractor has no
way of reimbursing you for any property damage he or she causes. This
means you end up paying the price. Likewise, if contractor carelessness
leads to injury or damage to someone else's property, the problem is
likely to become yours. No coverage under homeowner's policy. Most
homeowner policies require that any work to the property be done by
state licensed contractors; coverage is often specifically excluded for
damages caused by "bootleg" contractors.
Noncompliance with building codes. Unlicensed contractors may be unfamiliar with the applicable building codes as well as being unable to obtain building permits. If
your project doesn't comply with building and zoning codes, you will
probably be ordered to remove or repair the “code violation,” If not
