The Federal Trade Commission (FTC) Section 5 of the Act ref: http://www.ftc.gov/bcp/conline/pubs/buspubs/ruleroad.htm - stipulates, "Publishers and Advertising agencies are required by law to do diligence to promote fair competition." They should not simply rely on an advertiser's assurance that the claims are substantiated. Advertising must tell the truth and not mislead consumers. The FTC works for
the consumer to prevent fraudulent, deceptive, and unfair business
practices in the marketplace and to provide information to help
consumers spot, stop and avoid them.
The State Attorney's Generals Office requires Fictitious Business Names to be registered, which if not registered creates a traceability risk to consumers due to their ability to slip through the cracks to be included in local Yellow Page Directories, New Paper classified ads, as well as internet advertisements under Contractor categories; allowing the lawbreaker an ability to compete against the law-abiding contractor for your project!
